The following Privacy Policy, together with any documents they expressly incorporate by reference (collectively, these the "Privacy Policy" or "PP"), govern your access to and use of website and the services provided by us through the website and web interface platform, and chatbots (the “Services”). By using or accessing our Services, you agree to the Privacy Policies and the Terms of Service.

PERSONAL INFORMATION COLLECTED AND STORED BY AUDIODIVE

In order to carry out the Services and to provide a great user experience, we will collect, process and store the following information from you upon your visit of our website or chatbots or your use of our platform, some of which may be considered personally identifiable information:

  1. Your username, password and e-mail address when you register for an AudioDive account.

  2. Profile information that you provide for your AudioDive profile and any public profile information you provide on a social media account linked to your AudioDive account (e.g., first and last name, picture, phone number).

  3. Content (e.g., photos, comments, and other materials) that you post to the Service as a Content Creator or that you send as a reply to a chatbot.

  4. Any content you provide to AudioDive during communications between you and AudioDive directly, such as emails or phone calls to us.

How We Use Your Information

We will use your information as follows:

  • to administer your account with us and provide you with our services;

  • to respond to your inquiries and deliver reminder e-mails to you;

  • to provide you with information regarding updates and changes to our Website, our Terms of Service or any services we offer or provide through it;

How long we keep your information

We will retain your personal information for as long as you use our website, application and services and you participate in our programming.

You have the right to request that your personal information is permanently removed from our system and database at any time. Such request will be accommodated within 21 days.

COMMERCIAL AND NON-COMMERCIAL COMMUNICATION

By providing information to the Services, such as signing up for a newsletter or promotion, you waive all rights to file complaints concerning unsolicited email from AudioDive, since you have agreed to such communication by providing your information to us. However, you may unsubscribe from certain communications by notifying us that you no longer wish to receive solicitations or information. We will remove you from the database, where you have the right to request this under the Privacy Policy, Terms of Use

, or applicable law, or where AudioDive voluntarily decides to grant the request.

CHILDREN’S ONLINE PRIVACY PROTECTION ACT

The Services are directed at Fans and Curators over the age of 13 and Content Creators over the age of 18. We do not knowingly collect information from children under 13 years of age or have any reasonable grounds for believing that persons under the age of 13 are accessing the Services. If we discover any inadvertently collected Personal Information of a person under the age of 13, that information will be swiftly deleted from its’ records. YOUR CALIFORNIA PRIVACY RIGHTS

AudioDive welcomes residents of the State of California to use the Services, and complies with the California Business and Professions Code §§ 22575-22579. If you are a California resident you may request certain information regarding our disclosure of personal information to any third parties for their direct marketing purposes. USER ACCESS AND CONTROL

By accessing the Services through third-party social media websites such as Facebook, you have the ability to limit the personal data or information made available to AudioDive through the privacy setting. If you would like to access, review, correct, update, suppress, or otherwise limit our use of your personal information you have previously provided directly to us, you may contact us at privacy@audiodive.co. In your request, please include your email address, name, address, and telephone number and specify clearly what information you would like to access, change, update, or suppress. We will try to comply with your request as soon as reasonably practicable.

We reserve the right to make changes to this Privacy Policy at any time and will post changes on our Website or through our Service, so that you and other users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. Changes will not apply retroactively and changes addressing new functions for a service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms, you should discontinue your use of the Services.
